Business aviation has historically driven the industry to be as fuel efficient as possible, in turn powering innovative engine technology. Government incentives, regulatory transparency and flexibility, and dynamic technology will continue to drive business aviation towards a viable, more environmentally conscious future.

The attorneys and counselors at Jetlaw understand there are multiple approaches to securing a sustainable future in the aviation industry. Consumers are eager to understand and mitigate their impact on the environment. Business aviation allows its users to adapt their experience to fit within these priorities, helping the industry achieve net-zero by 2050.

Regulatory Path to Sustainability. Jetlaw focuses on regulatory compliance, transactional structuring, tax policy, and the promotion of emerging technology to foster a more enduring aviation industry. Jetlaw works with and advocates on behalf of operators and manufacturers before Congress and the Federal Aviation Administration (FAA) to create new rules and guidance around developing and sustainable technology. Because the attorneys at Jetlaw have worked on FAA rulemaking committees and even operated under the rigid standards of 14 C.F.R. Part 135, they offer companies a distinct perspective on the innerworkings of the FAA and the regulatory process. Fostering cooperation between industry stakeholders and the FAA will ensure safe, legal, and sustainable outcomes.

Access to Sustainable Aviation. Consumers are much more likely to live near an airport that is served by business aviation rather than a hub for a commercial airline. Across the United States, business aviation serves over 5000 airports, whereas commercial airlines only serve about 500 airports. This not only allows those in smaller, rural communities to reach their destination safely, but it drives economic growth in these areas. By using business aviation, consumers can play a role in promoting sustainability. Each consumer may create a unique operating structure and use profile for their aircraft.

Tax Incentives Promote SAF. Jetlaw’s tax practice assists consumers in maximizing the potential benefits of sustainable aviation fuel (SAF). In 2022, the Inflation Reduction Act (P.L. 117-169) created new, temporary tax credits to incentivize sustainable aviation fuel (SAF). The current SAF credit is $1.25 per gallon of SAF used in an eligible blend. To qualify, the SAF must achieve a 50-percent reduction in lifecycle greenhouse gas emissions. Moreover, the law allocates an additional credit of one cent for every percentage point in which the emissions reduction surpasses 50-percent.

Inspiring the Next Generation. Workforce development is a key to advancing sustainability in business aviation. Events and exposure to aviation help inspire a new generation of talent to join the aviation workforce and generate novel sustainability solutions. Many of the attorneys at Jetlaw are licensed pilots and compete in air races. The experimental and innovative aircraft used in air races have pushed the boundaries of what was previously thought possible in aviation design and engineering. For example, the use of carbon fiber and the development of electronic ignition for combustion engines both originated from air racing’s demands to reach the highest speeds possible with minimum fuel burn. Air racing events such as the women’s Air Race Classic serve as exposure and inspiration for the next generation of aviation professionals that keep the industry advancing to its net-zero by 2050 goal.
